De acordo com o Tribunal Superior do Trabalho (TST), Uber<\/strong> (NYSE<\/a>: UBER) e motoristas n\u00e3o possuem nenhum v\u00ednculo empregat\u00edcio. O TST rejeitou, mais uma vez, tal reconhecimento e a decis\u00e3o foi registrada na \u00faltima sexta-feira (11).<\/p>\t

O relator do processo, Alexandre Luiz ramos, disse que a liberdade de escolha do motorista quando ele trabalha ou deixa de trabalhar entra em conflito com a Consolida\u00e7\u00e3o das Leis do Trabalho<\/strong>. Neste processo contra a Uber, n\u00e3o caber\u00e1 recurso.<\/p>\n

\u201cO trabalho pela plataforma tecnol\u00f3gica, e n\u00e3o para ela, n\u00e3o atende aos crit\u00e9rios definidos nos artigos 2\u00ba e 3\u00ba da CLT, pois o usu\u00e1rio-motorista pode dispor livremente quando e se disponibilizar\u00e1 seu servi\u00e7o de transporte<\/strong> para os usu\u00e1rios-clientes, sem qualquer exig\u00eancia de trabalho m\u00ednimo, de n\u00famero m\u00ednimo de viagens por per\u00edodo, de faturamento m\u00ednimo, sem qualquer fiscaliza\u00e7\u00e3o ou puni\u00e7\u00e3o por esta decis\u00e3o do motorista\u201d, disse Ramos.<\/p>\n

A decis\u00e3o do TST<\/strong> na \u00faltima semana \u00e9 similar a deliberada em outro processo, ocorrido em fevereiro deste ano, envolvendo um motorista de Guarulhos, em S\u00e3o Paulo. \u00c0 \u00e9poca, a decis\u00e3o tamb\u00e9m foi un\u00e2nime.<\/p>\n

De acordo com a empresa de compartilhamento de viagens, 500 outros casos analisados em inst\u00e2ncias regionais possuem o mesmo teor e devem seguir o mesmo caminho.<\/p>\n

Na Calif\u00f3rnia, Uber deve tratar motorista como funcion\u00e1rio<\/h2>\n

Um juiz da Calif\u00f3rnia ordenou, no in\u00edcio de agosto que a Uber, assim como sua concorrente Lyft<\/strong> (NASDAQ<\/a>: LYFT), reclassifiquem seus motoristas como funcion\u00e1rios. Tal medida, que ainda pode ser interrompida no tribunal norte-americano, representaria o maior golpe para o modelo de neg\u00f3cios dos aplicativos de transporte.<\/p>\n

A decis\u00e3o \u00e9 vista como uma vit\u00f3ria para o procurador-geral da Calif\u00f3rnia<\/strong>, cujo processo, apoiado por procuradores-gerais de S\u00e3o Francisco, San Diego e Los Angeles, argumentou que os motoristas das empresas\u00a0enfrentam danos imediatos por n\u00e3o receber o mesmo tratamento, direitos e benef\u00edcios que um funcion\u00e1rio formal.<\/p>\n\t

Em novembro, eleitores da Calif\u00f3rnia ir\u00e3o decidir sobre uma medida para isentar os trabalhadores de aplicativos, da lei citada no caso em quest\u00e3o.
