Nesta a\u00e7\u00e3o, os ministros devem decidir se o uso da <a class=\"suno-keyword\" target=\"_blank\" data-force=\"no\" data-priority=\"3\" href=\"https:\/\/www.suno.com.br\/guias\/taxa-referencial\/\" rel=\"noopener\">Taxa Referencial<\/a> (TR) na corre\u00e7\u00e3o monet\u00e1ria das contas do <strong>FGTS<\/strong>, desde a d\u00e9cada de 1990, \u00e9 inconstitucional.<\/p>\n\n\n\n<p>Atualmente, o <strong>FGTS <\/strong>\u00e9 corrigido em 3% ao ano mais a TR, que tem rendido quase zero. O partido Solidariedade, autor da a\u00e7\u00e3o, argumenta que desde 1999 esse \u00edndice n\u00e3o \u00e9 suficiente para manter o <a class=\"suno-keyword\" target=\"_blank\" data-force=\"no\" data-priority=\"1\" href=\"https:\/\/www.suno.com.br\/artigos\/poder-de-compra\/\" rel=\"noopener\">poder de compra<\/a> dos trabalhadores, j\u00e1 que a varia\u00e7\u00e3o fica sempre abaixo do aumento da infla\u00e7\u00e3o durante esse per\u00edodo. A a\u00e7\u00e3o prop\u00f5e substituir esse m\u00e9todo de atualiza\u00e7\u00e3o por um \u00edndice inflacion\u00e1rio, como o \u00cdndice Nacional de Pre\u00e7os ao Consumidor (INPC).<\/p>\n\n\n\n<p>O julgamento teve in\u00edcio em 20 de abril, quando o ministro Lu\u00eds Roberto Barroso, relator da a\u00e7\u00e3o e atual presidente do STF, defendeu que os <strong>valores do FGTS<\/strong> deveriam garantir, no m\u00ednimo, uma remunera\u00e7\u00e3o equivalente \u00e0 da caderneta de poupan\u00e7a.<\/p>\n\n\n\n<p>A caderneta de poupan\u00e7a atualmente rende 0,5% ao m\u00eas mais a TR sempre que a <a class=\"suno-keyword\" data-force=\"no\" data-priority=\"1\" href=\"https:\/\/www.suno.com.br\/artigos\/taxa-de-juros\/\" target=\"_blank\" rel=\"noopener\">taxa b\u00e1sica de juros<\/a> (<strong>Selic<\/strong>) est\u00e1 acima de 8,5% ao ano (como \u00e9 o caso atualmente); e 70% da Selic quando a taxa b\u00e1sica est\u00e1 igual ou abaixo de 8,5% ao ano. A taxa Selic est\u00e1 atualmente em 12,75% ao ano.<\/p>\n\n\n\n<p>Barroso tamb\u00e9m enfatizou que a decis\u00e3o n\u00e3o deve retroceder, ou seja, os efeitos s\u00f3 devem ser v\u00e1lidos para o futuro, a partir da publica\u00e7\u00e3o da ata do julgamento. O ministro Andr\u00e9 Mendon\u00e7a, segundo a votar naquele dia, seguiu o voto de Barroso para impedir que o FGTS seja remunerado abaixo da poupan\u00e7a.<\/p>\n\n\n\t<p>\n\t\t<a href=\"https:\/\/lp.suno.com.br\/ebook-gratuito-investindo-no-exterior\/\" target=\"_blank\" data-element=\"shortcode-suno-banner\" title=\"Banner SUNO, clique e saiba mais\">\n\t\t\t<picture>\n\t\t\t\t<source media=\"(max-width: 500px)\" srcset=\"https:\/\/files.sunoresearch.com.br\/n\/uploads\/2023\/03\/400x300-Investindo-no-exterior.png\">\n\t\t\t\t<img class=\"newsContent__article__imgCapa newsContent__article__imgCapa--banner\"\n\t\t\t\t\tsrc=\"https:\/\/files.sunoresearch.com.br\/n\/uploads\/2023\/03\/1420x240-Investindo-no-exterior.png\"\n\t\t\t\t\tdata-promo-id=\"383161\"\t\t\t\t\t\t\t\t\t\twidth='1420' height='240'\t\t\t\t\talt=\"https:\/\/files.sunoresearch.com.br\/n\/uploads\/2023\/03\/1420x240-Investindo-no-exterior.png\"\n\t\t\t\t>\n\t\t\t<\/picture>\n\t\t<\/a>\n\t<\/p>\n\n\n\n\n\n<h2 class=\"wp-block-heading\">Impacto das mudan\u00e7as do FGTS<\/h2>\n\n\n\n<p>Segundo estimativas do Instituto<strong> Fundo de Garantia <\/strong>do Trabalhador, cerca de R$ 720 bilh\u00f5es deixaram de ser repassados aos trabalhadores entre 1999 e mar\u00e7o deste ano devido ao uso da TR em vez do INPC para a corre\u00e7\u00e3o dos saldos das contas.<\/p>\n\n\n\n<p>Em abril, a Advocacia-Geral da Uni\u00e3o (AGU) enviou uma manifesta\u00e7\u00e3o ao STF estimando um impacto de R$ 661 bilh\u00f5es nos cofres p\u00fablicos. Na ocasi\u00e3o, a AGU indicou que o FGTS poderia deixar de operar caso a a\u00e7\u00e3o seja aceita pelo STF. O cen\u00e1rio tra\u00e7ado pela Uni\u00e3o \u00e9 o mais extremo &#8211; que se concretizar\u00e1 caso a Corte decida que os valores corrigidos devem ser pagos retroativamente, de 1999 at\u00e9 hoje. A modula\u00e7\u00e3o de efeitos que a Corte aplicar\u00e1 permanece incerta.<\/p>\n\n\n\n<p>A a\u00e7\u00e3o est\u00e1 em andamento no STF desde 2014 e \u00e9 a quarta vez que o julgamento \u00e9 agendado, ap\u00f3s ser cancelado em 2019, 2020 e 2021.
