Com isso, o julgamento \u00e9 suspenso por at\u00e9 90 dias, quando o ministro \u00e9 obrigado a devolver o processo para julgamento. Foto: Dorivan Marinho\/STF\/Divulga\u00e7\u00e3o<\/figcaption>\n\t\t<\/figure>\n\t<\/div>\n\n\n\n\n\n\t<p>\n\t\t<a href=\"\" target=\"_blank\" data-element=\"shortcode-suno-banner\" title=\"Banner SUNO, clique e saiba mais\">\n\t\t\t<picture>\n\t\t\t\t<source media=\"(max-width: 500px)\" srcset=\"\">\n\t\t\t\t<img class=\"newsContent__article__imgCapa newsContent__article__imgCapa--banner\"\n\t\t\t\t\tsrc=\"\"\n\t\t\t\t\tdata-promo-id=\"240038\"\t\t\t\t\t\t\t\t\t\t\t\t\t\t\talt=\"\"\n\t\t\t\t>\n\t\t\t<\/picture>\n\t\t<\/a>\n\t<\/p>\n\n\n\n\n\n\n\n<p>A discuss\u00e3o \u00e9 se a <strong>Taxa Referencial (TR) <\/strong>deve ser substitu\u00edda por um \u00edndice ligado \u00e0 infla\u00e7\u00e3o, como o \u00cdndice Nacional de Pre\u00e7os ao Consumidor Amplo (IPCA).<\/p>\n\n\n\n<p>Em seu voto proferido na semana passada, o ministro relator, Lu\u00eds Roberto Barroso, defendeu que a <strong>corre\u00e7\u00e3o monet\u00e1ria do FGTS<\/strong> seja pelo menos igual \u00e0 da caderneta da poupan\u00e7a.<\/p>\n\n\n\n<p>Ele foi seguido por Andr\u00e9 Mendon\u00e7a.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Corre\u00e7\u00e3o do FGTS: veja poss\u00edveis mudan\u00e7as<\/h2>\n\n\n\n<p>O julgamento do Supremo Tribunal Federal (STF) que ir\u00e1 definir as taxas do <strong>Fundo de Garantia de Tempo de Servi\u00e7o<\/strong> (FGTS) pretende fazer uma <a class=\"suno-keyword\" target=\"_blank\" data-force=\"no\" data-priority=\"2\" href=\"https:\/\/www.suno.com.br\/artigos\/correcao-monetaria\/\" rel=\"noopener\">corre\u00e7\u00e3o monet\u00e1ria<\/a> atrelada \u00e0 infla\u00e7\u00e3o na taxa\u00e7\u00e3o do benef\u00edcio, o cen\u00e1rio para os trabalhadores de carteira assinada.&nbsp;<\/p>\n\n\n\n<p>A altera\u00e7\u00e3o deve girar em torno de qual indicador ser\u00e1 baseado na taxa\u00e7\u00e3o do FGTS. Desde 1999, a corre\u00e7\u00e3o \u00e9 feita com base na Taxa Referencial (<strong>TR<\/strong>) de 0,048% ao ano mais juros de 3%. A mudan\u00e7a aguardada pelos ministros \u00e9 de que a corre\u00e7\u00e3o seja feita com base em um dos \u00edndices oficiais da infla\u00e7\u00e3o, o \u00cdndice Nacional de Pre\u00e7os ao Consumidor (<strong>INPC<\/strong>).&nbsp;<\/p>\n\n\n\n<p>A TR vem sendo usada como base dos ajustes desde 1999, o que significa um abalo no <a class=\"suno-keyword\" target=\"_blank\" data-force=\"no\" data-priority=\"1\" href=\"https:\/\/www.suno.com.br\/artigos\/poder-de-compra\/\" rel=\"noopener\">poder de compra<\/a> dos trabalhadores que possuem dinheiro guardado no fundo.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Caso a corre\u00e7\u00e3o em 1999 em diante estivesse baseada no INPC, a soma dos fundos contaria com cerca de R$ 720 bilh\u00f5es a mais do que o saldo atual. Os c\u00e1lculos s\u00e3o do Instituto Fundo de Garantia (IFGT).<\/p>\n\n\n\t<p>\n\t\t<a href=\"https:\/\/lp.suno.com.br\/ebook-gratuito-investindo-no-exterior\/\" target=\"_blank\" data-element=\"shortcode-suno-banner\" title=\"Banner SUNO, clique e saiba mais\">\n\t\t\t<picture>\n\t\t\t\t<source media=\"(max-width: 500px)\" srcset=\"https:\/\/files.sunoresearch.com.br\/n\/uploads\/2023\/03\/400x300-Investindo-no-exterior.png\">\n\t\t\t\t<img class=\"newsContent__article__imgCapa newsContent__article__imgCapa--banner\"\n\t\t\t\t\tsrc=\"https:\/\/files.sunoresearch.com.br\/n\/uploads\/2023\/03\/1420x240-Investindo-no-exterior.png\"\n\t\t\t\t\tdata-promo-id=\"383161\"\t\t\t\t\t\t\t\t\t\twidth='1420' height='240'\t\t\t\t\talt=\"https:\/\/files.sunoresearch.com.br\/n\/uploads\/2023\/03\/1420x240-Investindo-no-exterior.png\"\n\t\t\t\t>\n\t\t\t<\/picture>\n\t\t<\/a>\n\t<\/p>\n\n\n\n\n\n<h2 class=\"wp-block-heading\">Risco para os cofres p\u00fablicos<\/h2>\n\n\n\n<p>Ao mesmo tempo que a mudan\u00e7a seria ben\u00e9fica diretamente para a reserva dos milh\u00f5es de trabalhadores brasileiros, a Advocacia-Geral da Uni\u00e3o (AGU) manifestou, segunda-feira, 17, um contra-argumento que pode abalar a economia.&nbsp;<\/p>\n\n\n\n<p>O \u00f3rg\u00e3o estima que, com esses ajustes, haveria um impacto de R$ 661 bilh\u00f5es nos cofres p\u00fablicos. Al\u00e9m disso, adverte que o FGTS n\u00e3o disp\u00f5e do caixa necess\u00e1rio para a a\u00e7\u00e3o e poderia perder sua capacidade de atuar.&nbsp;<\/p>\n\n\n\n<p>\u201cAli\u00e1s, a diferen\u00e7a entre o potencial impacto ao FGTS (R$ 661 bilh\u00f5es) e o seu <a class=\"suno-keyword\" target=\"_blank\" data-force=\"no\" data-priority=\"2\" href=\"https:\/\/www.suno.com.br\/artigos\/patrimonio-liquido\/\" rel=\"noopener\">patrim\u00f4nio l\u00edquido<\/a> poderia resultar na necessidade de aporte da Uni\u00e3o em aproximadamente R$ 543 bilh\u00f5es\u201d, afirma a AGU.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">FGTS: uma pauta de 2014<\/h2>\n\n\n\n<p>A proposta de <strong>revis\u00e3o do FGTS<\/strong> n\u00e3o \u00e9 novidade. Desde 2014, a a\u00e7\u00e3o tramita no Supremo, j\u00e1 tendo sido suspensa m\u00faltiplas vezes. O relator do assunto, o ministro Lu\u00eds Roberto Barroso, determinou a \u00faltima suspens\u00e3o, em 2019, ap\u00f3s o Supremo Tribunal de Justi\u00e7a (STJ) optar por unificar o entendimento e manter a TR como \u00edndice de corre\u00e7\u00e3o do FGTS, em 2018.&nbsp;<\/p>\n\n\n\n<p>O retorno da <strong>pauta do FGTS em julgamento <\/strong>\u00e9 importante para trabalhadores e para o Judici\u00e1rio. Este \u00faltimo foi inundado por a\u00e7\u00f5es individuais e coletivas, nos \u00faltimos dez anos, que reivindicavam a corre\u00e7\u00e3o do saldo do FGTS por um \u00edndice inflacion\u00e1rio.&nbsp;<\/p>\n\n\n\n<p>Desde 2020, o Supremo apontou como inconstitucional aplicar a TR como medida de <a class=\"suno-keyword\" target=\"_blank\" data-force=\"no\" data-priority=\"2\" href=\"https:\/\/www.suno.com.br\/artigos\/correcao-monetaria\/\" rel=\"noopener\">corre\u00e7\u00e3o monet\u00e1ria<\/a> de d\u00e9bitos trabalhistas. A decis\u00e3o foi tomada porque a l\u00f3gica da taxa, definida pelo Banco Central, leva em considera\u00e7\u00e3o uma l\u00f3gica de <a class=\"suno-keyword\" target=\"_blank\" data-force=\"no\" data-priority=\"1\" href=\"https:\/\/www.suno.com.br\/artigos\/juros-remuneratorios\/\" rel=\"noopener\">juros remunerat\u00f3rios<\/a>, sem se preocupar diretamente com a preserva\u00e7\u00e3o do poder de compra.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quem deve receber o reajuste?<\/h2>\n\n\n\n<p>A decis\u00e3o sobre quem recair\u00e1 a corre\u00e7\u00e3o ainda deve ser analisada pelo Supremo. Na teoria, seria poss\u00edvel que todos os cidad\u00e3os com carteira assinada a partir de 1999 teriam uma revis\u00e3o no saldo do<strong> FGTS<\/strong>.
