O <strong>FaceApp<\/strong> ficou famoso em julho por envelhecer rostos. As multas aplicadas foram, respectivamente, de R$ 9.964.615,77 para o Google, valor m\u00e1ximo previsto pelo C\u00f3digo, e R$ 7.744.320,00, para a Apple.<\/p>\n<p><span style=\"font-size: 1.21429rem;\">As duas empresas podem recorrer das multas. Entretanto, ambas informaram em nota que n\u00e3o v\u00e3o comentar o assunto.<\/span><\/p>\n<h2>Procon de olho no FaceApp<\/h2>\n<p>Segundo o <strong>Procon SP,<\/strong> na \u201cPol\u00edtica de Privacidade\u201d e \u201cTermos de Uso\u201d do <strong>FaceApp<\/strong> teriam sido disponibilizadas informa\u00e7\u00f5es em uma l\u00edngua estrangeira. A informa\u00e7\u00e3o adequada, clara e em l\u00edngua portuguesa \u00e9 direito b\u00e1sico\u201d, informou o \u00f3rg\u00e3o da Secretaria Estadual da Justi\u00e7a e Cidadania de <strong>S\u00e3o<\/strong>\u00a0<strong>Paulo.<\/strong><\/p>\n<p><a href=\"https:\/\/www.suno.com.br\/noticias\/bettina-procon-empiricus-publicidade\/\">Saiba mais: Caso Bettina: Procon multa Empiricus em R$ 58 mil por publicidade enganosa\u00a0<\/a><\/p>\n<p>O diretor-executivo da <strong>Funda\u00e7\u00e3o Procon SP,<\/strong> Fernando Capez, salientou que valores das multas s\u00e3o diferentes pois s\u00e3o calculados na base do faturamento de cada empresa no Brasil.<\/p>\n<h2>Cl\u00e1usulas abusivas na pol\u00edtica de privacidade<\/h2>\n<p>Al\u00e9m disso, segundo o <strong>Procon,<\/strong> Apple e Google estabeleceram cl\u00e1usulas na \u00a0\u201cPol\u00edtica de Privacidade\u201d e nos \u201cTermos e Servi\u00e7os\u201d consideradas abusivas pelo C\u00f3digo de Defesa do Consumidor<\/p>\n<p>Entre elas, est\u00e1 a possibilidade de compartilhar dados do consumidor com empresas do mesmo grupo, al\u00e9m de prestadoras de servi\u00e7os e organiza\u00e7\u00f5es terceirizadas. Uma pr\u00e1tica considerada ilegal no Brasil.<\/p>\n<p><a href=\"https:\/\/www.suno.com.br\/noticias\/facebook-amazon-apple-google\/\">Saiba mais: Facebook, Amazon, Apple e Google se apresentar\u00e3o ao Congresso dos EUA\u00a0<\/a><\/p>\n<p>Al\u00e9m disso, segundo o <strong>Procon,<\/strong> \u201cos dados do consumidor podem ser transferidos para outros pa\u00edses que n\u00e3o tenham as mesmas leis de prote\u00e7\u00e3o de dados que as do pa\u00eds de origem, o que implica em ren\u00fancia de direitos dos consumidores\u201d.<\/p>\n<p>Em \u00faltimo, as regras do aplicativo preveem que eventuais conflitos entre usu\u00e1rios e as empresas sejam resolvidos por um servi\u00e7o realizado no condado de Santa Clara, na Calif\u00f3rnia.
