A Comiss\u00e3o de Valores Mobili\u00e1rios (CVM)<\/a> publicou o novo Marco Regulat\u00f3rio dos Fundos de Investimento<\/strong> nesta sexta-feira (23), com a edi\u00e7\u00e3o da resolu\u00e7\u00e3o 175, trazendo mudan\u00e7as nas regras de funcionamento do mercado.<\/p>\t

Com a nova regulamenta\u00e7\u00e3o dos fundos de investimento<\/strong>, a CVM afirma buscar avan\u00e7os importantes para aumentar a efici\u00eancia no funcionamento do mercado de fundos.<\/p>\n\n\n\n

Desse modo, a autarquia quer diminuir os custos de observ\u00e2ncia para os participantes e, ao mesmo tempo, preservar a prote\u00e7\u00e3o dos investidores.<\/p>\n\n\n\t

As novas regras de funcionamento dos fundos de investimento<\/strong> passam a ter vig\u00eancia a partir de abril de 2023.<\/p>\n\n\n\n

Segundo o presidente da CVM, Jo\u00e3o Pedro Nascimento, as novas normas representam inova\u00e7\u00e3o e moderniza\u00e7\u00e3o.<\/p>\n\n\n\n

\u201cA nova regra de fundos de investimento<\/a> retrata a relev\u00e2ncia de um ambiente regulat\u00f3rio s\u00f3lido e funcional para esta ind\u00fastria t\u00e3o importante do Mercado de Capitais<\/a> do Brasil\u201d.<\/p>\n\n\n\n

Ele tamb\u00e9m explicou sobre a metodologia utilizada na elabora\u00e7\u00e3o do marco regulat\u00f3rio dos fundos.<\/p>\n\n\n\n

\u201cSeguimos uma metodologia inovadora em que adotamos normas gerais aplic\u00e1veis a todos os fundos de investimento, que s\u00e3o complementadas por regras em espec\u00edfico contidas em cada um dos anexos, que regulam as diferentes categorias de fundos de investimento<\/strong> existentes\u201d, completa.<\/p>\n\n\n\n

<\/a>Principais mudan\u00e7as do novo marco regulat\u00f3rio de fundos de investimento<\/h2>\n\n\n\n

Uma das mudan\u00e7as trazidas \u00e9 a limita\u00e7\u00e3o da responsabilidade dos cotistas no valor das cotas subscritas dos fundos.<\/p>\n\n\n\n

Na regra atual, existe a possibilidade de os investidores serem obrigados a aplicar valores extras em raz\u00e3o de preju\u00edzo vindo da estrat\u00e9gia aderida pela gest\u00e3o.<\/p>\n\n\n\n

Al\u00e9m disso, outra mudan\u00e7a \u00e9 a possibilidade de os fundos contarem com classes de cotas com patrim\u00f4nios segregados em cada classe.<\/p>\n\n\n\n

Outra altera\u00e7\u00e3o de regra trazida no ordenamento jur\u00eddico pela Lei de Liberdade Econ\u00f4mica<\/strong>, foi a aplica\u00e7\u00e3o do instituto da insolv\u00eancia civil<\/a> aos fundos.<\/p>\n\n\n\n

A nova norma tamb\u00e9m prev\u00ea que os fundos cuja aloca\u00e7\u00e3o acontece em ativos globais voltados ao investidor pessoa f\u00edsica<\/a> de varejo, tenham a possibilidade de expor totalmente seu portf\u00f3lio no exterior.<\/p>\n\n\n\n

Na regula\u00e7\u00e3o vigente, apenas os fundos destinados a investidores classificados como profissionais poderiam ter uma exposi\u00e7\u00e3o 100% no exterior. Ou seja, poderiam ter essa aloca\u00e7\u00e3o somente os fundos com investidores com aplica\u00e7\u00f5es financeiras<\/a> de pelo menos R$ 10 milh\u00f5es.<\/p>\n\n\n\n

O novo marco regulat\u00f3rio dos fundos de investimento<\/strong> tamb\u00e9m traz novas possibilidades de investimentos para Fundos de Investimentos Financeiros (FIF) e aos seus investidores, como os que investem em a\u00e7\u00f5es, c\u00e2mbio, renda fixa e os fundos multimercado.<\/p>\n\n\n\n

Nesse caso, h\u00e1 possibilidade de que os fundos invistam em \u201cativos ambientais\u201d e em criptoativos de forma direta. Al\u00e9m disso, a regra amplia os limites de concentra\u00e7\u00e3o por tipo de ativo financeiro<\/a> e estabelece limites de aloca\u00e7\u00e3o ao risco de capital.<\/p>\n\n\n\n

Antes da nova regra, apenas os fundos de investimento no exterior<\/strong> poderiam investir diretamente em criptoativos.<\/p>\n\n\n\n

Quanto aos Fundos de Investimento<\/strong> em Direitos Credit\u00f3rios (FIDC), a nova norma prev\u00ea que a responsabilidade pela estrutura\u00e7\u00e3o do fundo e por verificar o lastro dos direitos credit\u00f3rios \u00e9 do gestor. Os direitos credit\u00f3rios, por sua vez, agora precisam ser submetidos a registro.<\/p>\n\n\n\t
