Enquanto o destaque de alta ficou para o FII <a class=\"suno-keyword\" href=\"https:\/\/www.suno.com.br\/fundos-imobiliarios\/aiec11\/\" target=\"_blank\" rel=\"noopener\" data-force=\"yes\" data-priority=\"2\">AIEC11<\/a>, que subiu 5,71% no m\u00eas, na ponta negativo est\u00e1 o <a class=\"suno-keyword\" href=\"https:\/\/www.suno.com.br\/fundos-imobiliarios\/xpcm11\/\" target=\"_blank\" rel=\"noopener\" data-force=\"yes\" data-priority=\"2\">XPCM11<\/a>, com -14,30% de perdas acumuladas.<\/p>\n<p>Embora n\u00e3o conste em nenhum dos dois rankings, o fundo imobili\u00e1rio mais comentado no m\u00eas foi o <strong>Maxi Renda<\/strong> (<a class=\"suno-keyword\" href=\"https:\/\/www.suno.com.br\/fundos-imobiliarios\/mxrf11\/\" target=\"_blank\" rel=\"noopener\" data-force=\"yes\" data-priority=\"2\">MXRF11<\/a>), que protagonizou uma pol\u00eamica junto com a Comiss\u00e3o de Valores Mobili\u00e1rios (CVM).<\/p>\n<h3>MXRF11 vs CVM<\/h3>\n<p>Fundo imobili\u00e1rio com o maior n\u00famero de cotistas do Pa\u00eds (488 mil), o Maxi Renda foi questionado pela Comiss\u00e3o de Valores Mobili\u00e1rios quanto a sua <strong>distribui\u00e7\u00e3o de <a class=\"suno-keyword\" href=\"https:\/\/www.suno.com.br\/guias\/dividendos\/\" target=\"_blank\" rel=\"noopener\" data-force=\"no\" data-priority=\"1\">dividendos<\/a><\/strong>. A \u00e1rea t\u00e9cnica da autarquia verificou que o Fundo estava distribuindo rendimentos acima de seu <a class=\"suno-keyword\" href=\"https:\/\/www.suno.com.br\/artigos\/lucro-contabil\/\" target=\"_blank\" rel=\"noopener\" data-force=\"no\" data-priority=\"1\">lucro cont\u00e1bil<\/a> nos \u00faltimos anos, pr\u00e1tica vista como incorreta pela CVM.<\/p>\n<p>De acordo com o <strong>colegiado da CVM<\/strong>, um fundo imobili\u00e1rio s\u00f3 pode distribuir rendimentos at\u00e9 o limite de seu lucro cont\u00e1bil, excedente de caixa deve ser pago na forma de <strong>amortiza\u00e7\u00e3o<\/strong>. Quando em<strong> preju\u00edzo cont\u00e1bil<\/strong>, o FII n\u00e3o deve nem distribuir rendimentos.<\/p>\n<p>O caso repercutiu fortemente na ind\u00fastria, visto que a maior parte dos fundos imobili\u00e1rios distribui rendimentos segundo seu lucro caixa, em concord\u00e2ncia com um <strong>Of\u00edcio de 2014<\/strong> tamb\u00e9m da CVM. O Art. 10, da <strong>Lei 8.668<\/strong>, tamb\u00e9m prev\u00ea que os cotistas devem receber 95% dos lucros do Fundo, apurados segundo o <a class=\"suno-keyword\" href=\"https:\/\/www.suno.com.br\/artigos\/regime-caixa\/\" target=\"_blank\" rel=\"noopener\" data-force=\"no\" data-priority=\"1\">regime de caixa<\/a> \u2013 n\u00e3o o regime cont\u00e1bil.<\/p>\n\t<div data-element=\"shortcode-read-more\" class=\"knowMore\">\n\t\t\t\t<a class=\"knowMore__link\" href=\"https:\/\/www.suno.com.br\/noticias\/decisao-cvm-dividendos-mxrf11-respostas\/\">\n\t\t\tDecis\u00e3o da CVM sobre os dividendos do MXRF11: 8 respostas para entender o caso\t\t<\/a>\n\t<\/div>\n\n\n<p>A decis\u00e3o da<strong> CVM sobre o MXRF11<\/strong> foi comunicada no \u00faltimo dia 25. Dois dias depois, <a href=\"https:\/\/www.suno.com.br\/noticias\/cvm-decisao-mxrf11-resposta-casos-similares\/\" target=\"_blank\" rel=\"noopener\">a autarquia se pronunciou<\/a> reiterando sua posi\u00e7\u00e3o e esclarecendo que, apesar da decis\u00e3o ter como base um caso espec\u00edfico, ela \u201cpode se aplicar aos demais fundos de investimento imobili\u00e1rio que tenham caracter\u00edsticas similares \u00e0s do caso analisado\u201d.<\/p>\n<p>Nesta segunda (31), em uma \u00faltima atualiza\u00e7\u00e3o dessa novela, a <a href=\"https:\/\/www.suno.com.br\/noticias\/caso-mxrf11-cvm-suspende-decisao\/\" target=\"_blank\" rel=\"noopener\">decis\u00e3o sobre o MXRF11 foi suspensa<\/a>, a pedido dos administradores do Fundo, que ter\u00e3o de apresentar um pedido de reconsidera\u00e7\u00e3o do caso. Entretanto, n\u00e3o h\u00e1 previs\u00e3o de quando a autarquia dever\u00e1 apreciar o novo pedido.<\/p>\n<p>At\u00e9 l\u00e1, o pagamento de dividendos dos fundos imobili\u00e1rios dever\u00e1 continuar igual, visto que nenhuma normativa nova foi publicada e o caso ainda \u00e9 exclusivo do MXRF11.<\/p>\n\t<p>\n\t\t<a href=\"\" target=\"_blank\" data-element=\"shortcode-suno-banner\" <strong>Autonomy Edif\u00edcios Corporativos<\/strong> (AIEC11), que anunciou a conclus\u00e3o de uma arbitragem movida pela Dow Brasil, locat\u00e1ria que pediu na Justi\u00e7a a troca de indexador do aluguel, do IGP-M para IPCA.<\/p>\n<p>Em janeiro de 2021, o reajuste de <strong>aluguel da Dow<\/strong> chegou quase a 23%, percentual correspondente ao IGP-M acumulado de 12 meses. Em vista do valor alto correspondente do aumento, a empresa solicitou a uma corte arbitral a troca de indexadores.<\/p>\n<p>No \u00faltimo dia 18, o <strong>FII AIEC11<\/strong> comunicou que a decis\u00e3o da Justi\u00e7a foi pela manuten\u00e7\u00e3o do IGP-M, conforme indica em contrato. Com isso, parte do montante de aluguel retido durante a tramita\u00e7\u00e3o do processo, que somou R$ 3,5milh\u00f5es, foi liberado.<\/p>\n<p>Por\u00e9m, o juiz adicionou um item \u00e0 senten\u00e7a, que determina um reembolso retr\u00f3grado pelo AIEC11 \u00e0 Dow, no valor de R$ 700 mil. \u201c(\u2026) todos os demais itens da referida senten\u00e7a foram favor\u00e1veis ao Fundo, na medida em que foram julgadas improcedentes ou afastadas todas as pretens\u00f5es da Dow no \u00e2mbito da arbitragem\u201d, informa documento do FII.<\/p>\n<p>No dia, as<strong> cotas do AIEC11<\/strong> chegaram a subir cerca de 10% ao longo da sess\u00e3o. Ao final do preg\u00e3o, os ganhos se limitaram a 6,35%. No m\u00eas, o percentual positivo chegou pr\u00f3ximo: em 5,71%, valendo R$ 77,70 ante os R$ 74,50 do in\u00edcio de janeiro.<\/p>\n\t<p>\n\t\t<a href=\"\" target=\"_blank\" Desde ent\u00e3o, o Fundo ext\u00e1 com vac\u00e2ncia 100% e busca por inquilinos.<\/p>\n<p>Acontece que a atividade econ\u00f4mica na regi\u00e3o de Maca\u00e9, no Rio de Janeiro (RJ), desacelerou nos \u00faltimos anos com a redu\u00e7\u00e3o das opera\u00e7\u00f5es do setor de \u00f3leo e g\u00e1s. Os analistas da Suno Research sempre salientam que \u00e9 necess\u00e1rio antes poupar dinheiro para depois investir, e nunca se endividar para investir ou investir endividado.
